1. ACCEPTANCE OF TERMS

Welcome to BloxTap! These Terms of Service ("Terms") govern your access to and use of the BloxTap website located at bloxtap.com (the "Site") and any services provided by BloxTap ("BloxTap," "we," "us," or "our").

By accessing or using our Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Site or services.

2. DESCRIPTION OF SERVICE

2.1 Current Status

BloxTap is currently in development and no services are currently available. The Site currently serves only to:

  • Provide information about our planned NFC payment card services
  • Allow users to subscribe to our early access newsletter
  • Collect email addresses for future service notifications

2.2 Future Services

When launched, BloxTap intends to provide NFC-enabled cryptocurrency payment cards that enable Bitcoin and other cryptocurrency spending at compatible payment terminals ("Future Services"). These Future Services may include:

  • NFC payment cards linked to cryptocurrency wallets
  • Lightning Network payment processing
  • Tap-to-pay functionality at merchant terminals
  • DIY-compatible card programming
  • Integration with existing payment infrastructure

2.3 No Service Guarantee

We make no guarantee that Future Services will be launched, and we reserve the right to modify, suspend, or discontinue any planned services at any time without notice.

3. ELIGIBILITY AND GEOGRAPHIC RESTRICTIONS

3.1 Age Requirements

You must be at least 18 years old to use our Site or subscribe to our newsletter. By using our Site, you represent that you are at least 18 years old.

3.2 Geographic Restrictions

Our services are NOT available to residents of the following countries and territories:

  • Afghanistan
  • Bulgaria
  • Central African Republic

IMPORTANT: Our payment card technology is in development. When launched, it may:

  • Have limited merchant acceptance
  • Experience technical difficulties
  • Require software updates
  • Have compatibility issues with some terminals
  • Be subject to network outages or delays

5.2 NFC Technology Limitations

NFC payment cards are subject to:

  • Range limitations: Must be within close proximity to terminal
  • Terminal compatibility: Not all terminals support NFC payments
  • Power requirements: May require charged devices for some functions
  • Environmental factors: Performance may vary in different conditions
  • Technical interference: May be affected by other electronic devices

5.3 Lightning Network Dependencies

Our planned Lightning Network integration is subject to:

  • Lightning Network availability and performance
  • Channel liquidity and routing
  • Network fees and processing times
  • Third-party Lightning service providers
  • Bitcoin network congestion and confirmation times

6. CRYPTOCURRENCY RISKS AND DISCLAIMERS

6.1 High-Risk Activity

Cryptocurrency transactions and storage involve significant risks, including:

  • Volatility: Cryptocurrency values can fluctuate dramatically
  • Irreversibility: Transactions cannot typically be reversed or refunded
  • Technology Risks: Software bugs or network failures may result in loss of funds
  • Regulatory Risks: Laws regarding cryptocurrency may change
  • Security Risks: Risk of theft, hacking, or loss of access
  • Liquidity Risks: May not be able to convert crypto to fiat quickly

6.2 Payment Processing Risks

Cryptocurrency payments through our Future Services involve additional risks:

6.3 No Financial Advice

Nothing on our Site constitutes financial, investment, legal, or tax advice. You should consult with qualified professionals before making any cryptocurrency-related decisions.

6.4 Self-Custody Requirements

Our Future Services are designed to work with self-custody wallets, meaning:

  • Full Responsibility: You are solely responsible for securing your private keys
  • No Recovery: We cannot recover lost private keys or funds
  • No Custody: We do not hold or control your cryptocurrency
  • No Insurance: Your funds will not be insured by us or any government agency

7. INTELLECTUAL PROPERTY RIGHTS

7.1 Our Property

The Site and its content, including but not limited to text, graphics, logos, images, software, and card designs, are owned by BloxTap or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Open Source Components

While our website and branding are proprietary, we intend for some Future Services to incorporate open-source components in accordance with our commitment to transparency and community development.

7.3 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only.

8. PROHIBITED ACTIVITIES

You may not use our Site or Future Services to:

  • Attempt to defraud merchants or payment systems

  • Impersonate BloxTap or any other entity
  • Engage in any activity that could damage our reputation or business

9. MERCHANT AND TERMINAL COMPATIBILITY

9.1 No Guarantee of Acceptance

We cannot guarantee that our Future Services will be accepted by:

  • Any specific merchant or retailer
  • Any particular payment terminal or system
  • Any payment network or processor
  • Any geographic region or jurisdiction

9.2 Terminal Compatibility

Payment terminal compatibility depends on:

  • NFC/contactless payment support
  • Software versions and updates
  • Payment processor configurations
  • Merchant settings and restrictions
  • Local payment network requirements

9.3 Merchant Disputes

For disputes with merchants regarding:

  • Failed transactions
  • Incorrect charges
  • Refund requests
  • Service quality issues

You must work directly with the merchant. BloxTap cannot resolve disputes between users and merchants.

10. DISCLAIMERS

10.1 "As Is" Basis

The Site and any Future Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

10.2 No Service Warranties

We make no warranties that:

  • The Site will be uninterrupted or error-free
  • Future Services will be launched as described
  • Payment cards will work with all terminals
  • Transactions will always be successful
  • The services will meet your specific requirements
  • Security measures will prevent all unauthorized access

10.3 Third-Party Services

We may integrate with third-party services including:

  • Payment networks and processors
  • Lightning Network service providers
  • Cryptocurrency wallet providers
  • Merchant payment systems

We are not responsible for the performance, security, or privacy practices of these third-party services.

11. LIMITATION OF LIABILITY

11.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOXTAP'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR FUTURE SERVICES SHALL NOT EXCEED $100.

11.2 Excluded Damages

IN NO EVENT SHALL BLOXTAP BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, OR USE
  • BUSINESS INTERRUPTION
  • ANY DAMAGES ARISING FROM CRYPTOCURRENCY TRANSACTIONS
  • FAILED PAYMENTS OR TRANSACTION DISPUTES
  • MERCHANT ACCEPTANCE OR REFUSAL OF PAYMENTS
  • LOSS OF CRYPTOCURRENCY DUE TO USER ERROR

11.3 Basis of Bargain

These limitations are a fundamental part of the basis of the bargain between you and BloxTap.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BloxTap, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Site or Future Services
  • Your violation of these Terms
  • Your violation of any applicable laws
  • Any cryptocurrency transactions you conduct
  • Any disputes with merchants or other users
  • Any misuse of payment cards or services

13. PRIVACY AND DATA PROTECTION

13.2 Payment Data

When Future Services launch, we may process limited payment-related data for:

  • Private keys or wallet seed phrases

  • Payment Card Industry (PCI) standards
  • Consumer protection regulations

Cryptocurrency and payment regulations are rapidly evolving. We reserve the right to:

  • Restrict services in certain jurisdictions
  • Terminate services if compliance becomes impractical

15. MODIFICATIONS

You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.

18.5 Force Majeure

We shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control.
